These Landmark Legal Cases Shaped
America’s Legal Landscape
Marbury v. Madison was a historic case that established the precedent of judicial review. The ruling cemented the authority of the Judicial Branch to declare a law unconstitutional and firmly established the checks and balances the founding fathers had intended.
McCulloch v. Maryland, the Supreme Court allowed for implied powers of the federal government according to the “necessary and proper” clause of the Constitution.
This case allowed the powers of the federal government to expand and evolve beyond that specifically written in the Constitution. It allowed for the government to shed the last vestages of the Anti-Federalist / Jeffersonian view of the USA based on limited size of government, a lose federation of states all individually equal and powerful. The ruling opened the door for the unbridaled expansion of the central government and its influence.
Gibbons v. Ogden established the supremacy of the federal government over state’s rights. The case gave the federal government the power to regulate interstate commerce.
This case was pivitol in establishing the power of the central (federal) government over the governments and people of states.
Korematsu v. United States upheld the conviction of Frank Korematsu for defying an order to be interned with other Japanese-Americans during World War II.
This ruling placed the security of the United States over individual rights and again has entered the political landscape with the Patriot Act in the early 2000’s.
Griswold v. Connecticut was a ruling regarding the control of and imprisonment of people for using contraception.
Roe v. Wade was a battle over the right to have an abortion. The case and the ruling was not what most believe. Both were very specific and were wrapped around vagueness of the law and the nineth ammendment rights.
